You’re building on-chain in Singapore. Whether what you issue counts as a financial product decides most of what follows.

Information, not advice

This page is information, not legal advice about your matter. A retainer begins only when a lawyer confirms it.

Start here

Work out what your asset legally is, first

Whether MAS treats it as a digital payment token or a capital markets product decides your licence and what you may say in marketing.

What to work through, in order

Characterising the asset

Whether MAS treats the asset as a digital payment token, a capital markets product, or neither. The rights attached to it decide, not the marketing description.

Custody and who holds the keys

MAS requires digital payment token service providers to segregate customer assets, hold the majority in cold storage, and maintain custody arrangements it can inspect.

Tax treatment

Digital payment tokens used as payment are exempt from GST, and whether gains are capital or revenue depends on the badges of trade. There is no general capital gains tax.
