Know which rules already apply to you, before you add anything new
Adding a service changes what your MiCA authorisation covers, and that authorisation passports across the bloc. Checking where you stand first is cheaper than correcting it later.
What to work through, in order
Registration and licensing
MiCA authorisation as a crypto-asset service provider, granted by a national competent authority and passportable across the bloc. Existing MiFID firms can notify rather than reapply for some services.
Staking, lending and yield
MiCA does not authorise lending or yield products as such, so these arrangements are assessed against MiFID II, AIFMD or national rules depending on structure.
Transfer information and record keeping
The Transfer of Funds Regulation applies the travel rule to crypto-asset transfers with no de minimis threshold, and the new AML package tightens it further.
